ATTORNEY-ADVISER (GENERAL)

As a ATTORNEY-ADVISOR, GS-0905-12, you will advise Commander and staff on interpretation of federal statutes and regulations, ensure that legal advice, consultation, and collaboration is furnished in a timely manner. Provide advisory, guidance, consultation, and collaboration to Commander, staff, and supervisors. As the SME in Government Ethics, provide training to all unit members, staff and personnel on matters such as 1) Financial disclosure programs and reviews; 2) Ethics counselor program training, advice and assistance; 3) Post-government employment program advice and assistance; and 4) Gift acceptance programs, including gifts of travel, gifts to the command and service member. Provide legal assistance on a non-interference basis to members of the ANG, spouses of members, and family members as authorized by ANGI 51-504, AFI 51-504 (when applicable), CNGBI, NGR, and other AF/JA guidance and, as resources and expertise permit, legal assistance may also be provided to Active Component members, other Reserve Component members, and retirees of any military service. Formulate Wing legal policy and its execution; legal representation; legal initiatives; constitutional, civil, criminal, labor law; a full spectrum of expert legal advice to Wing leaders. Prepare and render legal advice and opinions to commanders and senior staff regarding military justice options. Provide legal advice, legal briefings, and counsel to Wing leadership on the DES process. Provide professional legal advice and opinions on issues arising from federal laws and regulations and their application to the National Guard or concerning the federal mission of the National Guard, including homeland defense and security, emergency response, and application of state/territory compacts. EXCEPTED This is a Dual Status Excepted Service Technician position in the Pennsylvania Air National Guard. AREA OF CONSIDERATION:
Non-Bargaining Position Individuals who are currently serving in another branch of service who are willing to become members of the Pennsylvania National Guard. INDEFINITE:
Currently employed permanent technicians MAY BE able to retain their permanent status and based on the current Unit Manning Document (UMD) and projected resourcing this will allow the applicant to occupy this position as a Permanent Promotion or Reassignment. If there are projected changes in the funding resourcing of the advertised position individuals will be placed on a Temporary action such as Temporary Promotion or Temporary Reassignment. These actions may result in the employee having to return to their prior Permanent Position when changes to the manning occur. Indefinite employment status pertains to applicant nominated, who are not a currently employed permanent technician. Indefinite appointments may acquire permanent status depending upon future force structure requirements; indefinite appointments do not serve a trial period. Indefinite appointments may be separated when their services are no longer needed or when funding is no longer available via a 30-day termination notice. Military Grades:

Experience:
Applicant must indicate at least 36 months experience, education or training in the preparation of cases for trial and/or tries cases before a court or an administrative body of persons having quasi-judicial power, the rendering of legal advise and services with respect to questions, regulations, practices or other matters falling within the purview of a Federal Government, the preparation of interpretive and administrative orders, rules, or regulations to give effect to provisions of governing statutes or other law requirements. Skill in analyzing, discussing and providing oral and written counsel on complex legal arguments in a representative capacity in a manner that aids the recipient in understanding the issues, options, and recommended courses of action. KNOWLEDGE, SKILLS, AND COMPETENCIES:
Applicants who meet the eligibility requirements will be further evaluated by the nominating supervisor based on the following competencies considered essential to perform the duties and responsibilities of the position. - Knowledge in homeland defense and security, emergency response, sovereignty, application of state/territory compacts, fiscal and contract law, civil domestic support, employer support, military statute and administrative law (Federal & state/territory), non-military employment law (Federal & state/territory), administrative law, environmental law and emerging areas of law, i.e. Intelligence and cyber law, weapons of mass destruction emergency response and assistance to civil authorities, etc. - Knowledge in preparing and rendering legal advice on disciplinary matters, nonjudicial punishment, and statutory pretrial advice in prospective court-martial cases. - Knowledge in preparing statutory post-trial advice and actions of convening authority. - Skill in providing legal assistance with respect to the following legal matters to eligible beneficiaries:
wills, powers of attorney, living wills and health care directives, notary services, dependent care plans, casualty affairs (death incident to the performance of military duty), employment problems arising from the performance of military duty and subject to the Uniformed Services Employment and Reemployment Rights Act (USERRA) or a similar state statute, landlord-tenant problems specifically related to performance of military duty, tax problems specifically related to performance of military duty, matters arising from the performance of military duty and subject to the Service members Civil Relief Act (SCRA) or a similar state statute, providing special victim's counsel (SVC) services, and other legal assistance as approved by the National Guard Bureau (NGB) and the Air Force, or by the State Headquarters (HQ) Staff Judge Advocate (SJA), the Wing Commander (CC), or other appropriate commander (CC), or the unit SJA. - Skill in preparing, researching and issuing oral and written opinions, and may, upon designation by the State Adjutant General, participate in collective bargaining as a member of the management negotiating team and represent the organization in third-party administrative, quasi-judicial, and judicial proceedings. - Skill in conducting classes and training for commanders, staff and other personnel on a variety of administrative and operational areas. - Ability to serve as the Wing Ethics counselor when delegated by NGB and/or the State Staff Judge Advocate, and prepares opinions and furnishes advice on a wide variety of ethics law issues, including pre and post-employment restrictions, standards of conduct and conflict of interest issues, and contact with prohibited sources and ensures the filing of Financial Disclosure Reports and Confidential Statements of Affiliations and Financial Interest. - Ability to coordinate with State Human Resources Office and the State Judge Advocate on all labor law training as well as impact on established programs, procedures, and methods of operation. - Ability to prepare, researche, and issue oral and written legal opinions and legal advice with regard to a wide variety of laws, regulations, instructions, directives and policies in the area of Administrative Law, including but not limited to:
Freedom of Information Act, Privacy Act, reports of survey, line-of-duty determinations, constitutions and by-laws of private organizations, formal and informal investigations and commanders' inquiries, legal sufficiency reviews, collateral investigations, federal and state Uniform Code of Military Justice (UCMJ) complaints, Congressional Inquiries, Inspector General investigations, Equal Opportunity/Equal Employment Opportunity (EO/EEO) investigations, fiscal law, unfavorable personnel actions, standards of conduct, family advocacy, and public relations. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
